Terms and Conditions

These Terms and Conditions apply to all commissioned artwork created by Sarah-Jayne Roberts ("I", "me", "my"). By placing an order through this website or accepting a quotation for commissioned artwork, you ("the Client") agree to these Terms and Conditions. Please read them carefully before placing your order.

 

PRICE QUOTATION 

I will provide you with a written quotation for the requested artwork. This quotation will be based on the cost of materials, estimated hours of work, and any additional charges that may apply. Prices are subject to change based on the complexity of the project but will be agreed upon before work begins.

ACCEPTANCE OF THE COMMISSION

Acceptance of the commission must be made in writing (email is acceptable). By accepting the commission, you agree to these Terms and Conditions.

 

BOOKING FEE

 

A booking fee of 25% of the total quoted price is required to secure your commission slot. This booking fee will be deducted from the remaining balance payable upon completion of the artwork. Unless otherwise stated in the Cancellation section, if you cancel your commission, the booking fee will not be refunded, although I may, at my discretion, allow it to be transferred to a future commission.

PHOTO PROVISION

For commissions based on photographs, you must provide high-quality, clear photographs. The quality of the commissioned artwork is directly related to the quality of the photograph provided. I reserve the right to reject any photographs that do not meet the necessary quality standards.

REFERENCE PHOTOGRAPHS

By supplying reference photographs for your commission, you confirm that you own the photographs or have permission from the copyright owner to use them. You also confirm that you have permission from any identifiable individuals (or their parent or guardian, where applicable) to have the artwork created.

COPYRIGHT

 

I retain full copyright and all intellectual property rights in every artwork created, including commissioned works. You are purchasing the original artwork only and do not acquire any copyright or reproduction rights unless agreed separately in writing.

TIMESCALE 

The completion time for a commission varies depending on my current workload, the complexity of the piece, and the size of the artwork. An estimated completion date will be provided when the commission is accepted. However, this is an estimate and not a guarantee. I will keep you updated throughout the process and let you know if there are any changes to the estimated completion date. 

SHARING ON SOCIAL MEDIA

I reserve the right to photograph and reproduce commissioned artwork for use on the website, social media, exhibitions, portfolios, and promotional material. Clients who do not wish their commissions to be posted publicly should state this in writing. If the piece is a surprise, I will wait until it has been gifted, so please be sure to tell me. 

 

CANCELLATION

As each commission is created specifically for you, I ask that you notify me as soon as possible if you wish to cancel your commission.

 

I offer a 14-day cooling-off period from the date your booking is confirmed. If you change your mind and cancel your commission during this period and I have not started work on your artwork, your booking fee will be refunded in full.

If you cancel your commission after the 14-day cooling-off period but before I have started work, your booking fee will not be refunded. The booking fee covers the reservation of your commission slot, administration and payment processing costs. However, at my discretion, I may allow the booking fee to be transferred to a future commission.

Once I have started work on your personalised artwork, cancellation will generally not be possible due to the bespoke nature of the commission. If you choose to cancel after work has begun, your booking fee will be retained to cover the materials used and the time spent creating your personalised artwork.

In the unlikely event that I need to cancel your commission, I will refund your booking fee in full.

ARTWORK AMENDMENTS

Every effort will be made to ensure you are delighted with your artwork. Progress photographs will be provided throughout the creation of your artwork, giving you the opportunity to request reasonable amendments before completion.

 

A final photograph of the completed artwork will be sent to you for approval before the remaining balance is requested. Please take this opportunity to notify me of any reasonable amendments.

 

Minor amendments that do not significantly alter the completed artwork will be made at no additional cost. Requests for major changes, changes to the original reference photograph, or additional amendments after approval may not be possible and, where accepted, may incur an additional charge.

 

Due to the nature of coloured pencil artwork, significant alterations may not be possible once the artwork has been completed.

If amendments are agreed after the artwork has been delivered, you will be responsible for the safe return of the artwork and the cost of postage both to and from me.

If, after all agreed amendments have been completed, you decide not to proceed with the purchase of the finished artwork, you will not be required to pay the remaining balance. However, your booking fee will be retained to cover the cost of materials and the time spent creating your personalised artwork.

BALANCE PAYMENT

 

Once you have approved the completed artwork, the remaining balance will become payable.

 

The artwork will not be shipped or delivered until the full payment has been received.​ 

 

Payment can be made via a digital invoice with a secure online payment link or by bank transfer. Your invoice will be sent to the email address you have provided.

DELIVERY

Delivery is currently available to mainland UK addresses only. If this changes in the future, the website will be updated accordingly.

Once the final payment has been received, the artwork will be securely packaged and shipped within 3 working days. All artwork will be sent using a tracked and insured postal service selected by me, depending on the value of the artwork. Delivery costs are included in the price of your artwork unless otherwise stated.

Every care is taken to package your artwork securely to ensure it arrives safely. If your artwork arrives damaged, please notify me within 48 hours of delivery and provide photographs of both the damaged packaging and the artwork.

 

If the artwork is damaged beyond repair during transit,  a replacement piece will be created at no additional cost. The timescale for the replacement will depend on my current commission schedule.

 

Responsibility for the artwork passes to you once it has been confirmed as delivered by the courier.

EVENTS BEYOND MY CONTROL

I shall not be liable for delays caused by circumstances beyond my reasonable control, including illness, accidents, severe weather, postal disruption, supplier delays or other unforeseen events. Should this occur, I will keep you informed and provide an updated estimated completion date.

GOVERNING LAW

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

PRIVACY

Any personal information you provide when placing an order or contacting me will be handled in accordance with my Privacy Policy, which is available on this website.

CHANGES TO THESE TERMS

I reserve the right to update these Terms and Conditions from time to time. The latest version will always be available on this website.
